In California, it's Big Tobacco vs Lance Armstrong

SAN FRANCISCO (AP) ? Fabled as a mecca for the health-conscious and fitness-obsessed, California is also one of only a few states that has not hiked its cigarette taxes in the last decade, meaning it is less expensive to light up in Los Angeles and San Francisco than in many other places in the country.

The tobacco industry wants to keep it that way.

It has amassed nearly $50 million to kill an initiative before California voters that has been championed by cycling star Lance Armstrong and supported by New York Mayor Michael Bloomberg, who has donated $500,000 to its campaign.

Marlboro-maker Altria Group Inc., RJ Reynolds and other tobacco heavyweights have spent their millions on a media blitz to snuff out Proposition 29, which would slap an additional $1-per-pack tax on cigarettes and other tobacco products to fund cancer research.

If the tax passes, California would still have only the 16th highest tax rate in the nation, at $1.87 per pack. But tobacco companies and their allies say that voter approval of an extra tax in the nation's largest cigarette market would crush owners of small businesses and spark anti-smoking measures elsewhere.

They say the measure on Tuesday's primary ballot is flawed and would create a giant, unaccountable bureaucracy.

"We all know that Big Tobacco has poured tens of millions in this campaign saying, 'Don't tax us any more,'" said Armstrong, who beat testicular cancer that had spread to his brain and lungs more than a decade ago. "But the fact of the matter is the product they sell leads to about $9 billion a year in health care costs for California. I think if this passes, other states will follow."

Its passage is uncertain.

The Public Policy Institute of California found that support for the initiative dropped from 67 percent in March to 53 percent by late May, reflecting the blizzard of radio and TV ads from the tobacco industry.

A statewide Field Poll released Thursday found that 50 percent of likely voters said they will vote yes on the measure, with 42 percent voting no and 8 percent undecided.

As the primary approaches, Armstrong and other smoking foes, including Bloomberg and Laurene Powell Jobs, the widow of the late Apple CEO Steve Jobs, are pouring in their own money to counter the industry.

Bloomberg has banned smoking in New York City bars and parks during his decade in office.

"California is a particularly important state, and it's very visible on this issue," he said in a telephone interview. "A lot of people there will die unless we do something to stop Big Tobacco."

The $12.3 million anti-smoking groups have raised comes to about one-fourth of the $46.8 million war chest built by the major tobacco companies. The anti-tax contributions exceed those of any other federal independent expenditure committee except the "Restore Our Future" super PAC supporting Republican presidential candidate Mitt Romney, according to recent campaign finance figures.

Smoking is not as common in California, the nation's most populous state, as it is in other pockets of the country. Smoking rates are among the nation's lowest in California, at 12.1 percent, and highest in Kentucky, at 24.8 percent, the federal Centers for Disease Control and Prevention found in 2010.

Still, California represents a huge market for the tobacco industry. Smokers in the state bought about 970 million packs of cigarettes ? spending approximately $5.2 billion ? in fiscal year 2010, the most recent year for which national figures are available. Some of that money went to an existing tobacco tax, which sends 25 cents from each pack purchased to fund anti-smoking programs, provide health care services to the poor and fund tobacco-related research.

That helped reduce tobacco sales. In the 15 years after it went into effect in 1988, the industry lost $9.2 billion in pre-tax sales, according to a study by researchers at the University of California, San Francisco's Center for Tobacco Control Research and Education.

Then, in 2006, tobacco companies spent $66 million to defeat a previous measure that would have created an extra $2.60-per-pack tax.

So far, the opposition campaign has centered its messaging on the state's budget mess, calling the California Cancer Research Act a folly that will force taxpayers to support a group of political appointees who will send research money out of state. Opponents also have said it could end up raising millions of dollars yet produce little research that develops new cancer treatments, charges the measure's supporters say are baseless.

"The tobacco companies realize that we have a like mind in opposing both tax burdens and policies that create a business-unfriendly environment," said Joel Fox, president of the Los Angeles-based Small Business Action Committee, which he said has received hundreds of thousands of dollars from tobacco companies to support anti-tax policies in the last decade. "It's the first domino of potentially taxing all kinds of products."

The nonpartisan California Legislative Analyst's Office says Proposition 29 would generate about $735 million a year in revenue if approved.

The anti-tax campaign has been quick on the ground, launching radio and TV commercials a month and a half ago.

Armstrong and his coalition, including the American Cancer Society, American Lung Association, American Heart Association and California Medical Association, were too poor to mount an early advertising campaign, he said.

Aside from Armstrong, who visited with young patients during an event at a Los Angeles children's hospital earlier this month, the measure has not attracted much celebrity support. Laura Ziskin, a Hollywood producer celebrated for the "Spider-Man" movie franchise, was on the initiative's campaign board until she died last year of breast cancer.

Even so, in the final days before the primary, the battle over Proposition 29 is arguably the most high-profile campaign in an election season that has failed to generate much enthusiasm.

"The supporters and opponents wouldn't spend these millions of dollars if these commercials weren't persuading voters," said Daniel Newman, president of MapLight, a nonpartisan group that analyzes money's role in politics. "When one side has a specific financial interest, they are going to spend much more because they get such a high return on investment."

Stewart, Colbert pour criticism on big-drink ban

Comedy Central

By Chiderah Monde, TODAY.com contributor

Both ?Daily Show? host Jon Stewart and ?Report? host Stephen Colbert are among the New Yorkers outraged at Mayor Michael Bloomberg?s proposed ban on super-sized sugary drinks. Bloomberg's war on the obesity epidemic may have good intentions,?but some think banning sodas over 16 ounces in restaurants, theaters, ballparks -- and virtually everywhere else one would have a giant guzzler -- is simply not the way to do it.

Not only is it an argument of government interference, Stewart points out, it?s also not the New York way. At any given restaurant we have sandwiches with piles of roast beef, mounds of chicken wings served with bowls of sauce, and frozen hot-chocolate drinks with more sugar than should be legal ... and yet, we can?t wash it all down with a refreshing, sugary Mountain Dew?!

?What about the 7-Eleven Slurpee?!? Stewart asks. Well, those are fine because Bloomberg?s law would not apply to drinks sold in non-government affiliated grocery and convenience stores.

?Look, Mr. Mayor,? Stewart began, ?I know you can be intimidated by these large-sized drinks. You and I are both ... let?s face it, small. We might see a generously-proportioned sugared beverage and think of it as a drowning hazard, but it?s not fair!?

Colbert didn?t take it so well either.

?First he banned smoking, then he banned trans-fat,? Colbert began. ?Then he added bike lanes everywhere, and now?he?s gone way too far. This is America, the land of plenty! We haven?t achieved Type 3 Diabetes yet!?

After much whining, Colbert accepts his new reality and is forced to do one of the hardest things he?s had to do in a long time.

He has to shoot Drinky, his pet giant drink. A tearful goodbye, indeed.

Do you agree with the comic hosts, or applaud the mayor? Discuss on our Facebook page.

(AP) ? Keep your friends close, and your former presidents closer.

President Barack Obama is welcoming his favorite foil, former President George W. Bush, back to the White House on Thursday for the official unveiling of Bush's portrait. Given the history, the scene ought to be quite a picture.

Obama is still bad-mouthing Bush's time in office, and it's not just because of the debt and the unfinished wars Obama inherited. Obama sees Bush's economic ideas as the same as his current rival, Mitt Romney, so he lumps them together.

Which makes it a little awkward that Obama is about to preside as Bush's image and legacy are enshrined forever.

Never mind all that, say the Obama and Bush camps. This is a timeout for tradition.

The political reunion is expected to put aside any campaign rhetoric, as other gatherings among past and current presidents have, to honor nostalgia and the service of the former president and his wife, Laura.

In the heart of a re-election year, Obama will to get to rise above the fray for a day and play statesman.

He and his wife, Michelle, will host generations of Bushes for a private lunch, including former President George H.W. Bush and former first lady Barbara Bush. Family members will join them.

Then, in the ornate East Room, Obama and George W. Bush will speak as the portraits of the former president and Laura Bush are unveiled. The audience will be filled with friends and officials from Bush's two terms in office.

No one close to the current or former president expects the least sign of animus Thursday, particularly given that their transition in 2009 was handled with grace and that they have since shared moments of help and healing.

"President Bush has been around politics a long time. He's been around how presidents deal with each other for a long time," said Tony Fratto, one of his former spokesmen at the White House. "He has an understanding for separating the necessities of political rhetoric from the job itself."

Still, Bush has been holding his tongue for a long time. Obama has never run against Bush, although it was easy to forget that during the 2008 race between Obama and Sen. John McCain, when Bush's tenure was so often Obama's target.

In his inaugural address in 2009, Obama declared that "we are ready to lead once more," seen by some as a dig at Bush, who was seated over his shoulder. Even now, hardly a day goes by when Obama's team does not blame Bush for a mess.

It was just one week ago that Obama, revving up campaign donors, turned Bush into a punch line. Obama depicted presumptive Republican presidential nominee Romney as a peddler of bad economic ideas, helping the rich at the expense of the middle class. He then added: "That was tried, remember? The last guy did all this."

Now the last guy is coming back.

Only 43 men in history, and five men alive, have held the job.

It will be a rare limelight moment for Bush, who has not been back in more than two years.

Obama and Bush have a cordial and respectful relationship, but they are not close.

Both are political veterans who are able to separate political tactics from what they see as an overarching community among people who have served in the Oval Office, according to people close to them.

History has marked this moment before, with grudges put aside.

When Bill Clinton came back for his portrait unveiling, Bush lauded him for "the forward-looking spirit that Americans like in a president." This after he ran for the presidency to "restore honor and dignity" after Clinton's sex scandal.

And when Clinton welcomed back George H.W. Bush, whom he had defeated, he said to him and his wife: "Welcome home. We're glad to have you here."

"I would be surprised if there's very much tension" this time around, said Cal Jillson, a political science professor at Southern Methodist University who has long followed Bush's career.

Obama has enlisted Bush's help on earthquake relief for Haiti, and the two stood together in New York City last year in marking the 10th anniversary of the Sept. 11 attacks on America. They have also spoken at least three times at signature moments over the last three years, including the killing of Osama bin Laden.

Still, Obama's bashing of Bush's record sets a backdrop.

"This president is looking for someone to blame," Romney said while campaigning in Colorado this week. "Of course, he started off by blaming George Bush, and that worked for a while but, you know, after three and a half years that wears kind of thin."

The White House points out that Obama praises Bush sometimes, too, such as for taking on illegal immigration.

The visit is layered with political story lines.

Bush's brother Jeb is a potential vice presidential candidate to Romney. Bush's father has developed a kinship of sorts with Obama. And then there is Bush himself, who has endorsed Romney but is still viewed by many in his party as politically toxic.

More than any president in recent memory, Bush has not just intentionally faded from the public spotlight but all but disappeared from it.

Bush was last at the White House in January 2010 to help out with Haiti humanitarian relief.

Bush spokesman Freddy Ford said the former president and first lady are grateful to the Obamas and looking forward to catching up with faces from their past, including staff at the Executive Mansion.

Jenna Bush Hager, one of the George W. Bush's daughters, told "Fox & Friends" the day will be a chance to "celebrate his work, 'cause he worked pretty hard, so I think he deserves at least a painting."

As to where it will go, she said: "Probably in the very back somewhere. I'm just kidding."

Actually, the painting will hang prominently in the formal entrance hall to the White House, the Grand Foyer.
